Setting Precedence in
Health Insurance Rescission
In 2007, Mr. Nutter set the tone for health
insurance rescission cases when the
California Court of Appeal agreed with he and
his co-counsel, Jeffrey L. Garland, in the high
profile case, Hailey v. California Physicians'
Service, that health care service plans cannot
rescind policies because of an unintentional
misrepresentation by a policy holder.
The court determined a health plans must
show the policy holder intentionally made a
misrepresentation and that a rescission of a
health-care plan can subject the insurance
company to an infliction of emotional distress
claim.
