Protecting Debtors Rights In Bankruptcy

Mr. Nutter realizes in today's economy many individuals and business
owners are struggling financially as they face major life changes, usually
caused by divorce, job loss or unexpected medical expenses. He wants
to help people who are over extended and can't pay their bills and monthly
obligations.

Get relief under the bankruptcy laws, whether it's a
Chapter 7 or Chapter
13 bankruptcy. He will evaluate your assets, debts and income to make
sure you quailfy for relief under Chapter 7 to wipe out your debts and get a
fresh start.  If you do not qualify for Chapter 7, he will analyze your income
and expenses to make sure you can fund a plan to make monthly
payments to your creditors through the bankruptcy trustee and pay the
proper creditors directly.

The Bankruptcy Reform Act of 2005 requires that you pass a "means test",
which means you must earn less than your state's average monthly
median income.  
Review this table provided by the U.S. Trustee Program
to see if you earn less than your states median.  

If you are thinking about filing Chapter 7 bankruptcy you can complete
bankruptcy form
22a  "Statement of Current Monthly Income and Means
Test Calculation" to see if you earn less than the median income in your
state.  If you learn less than the median income in your state, you qualify
for Chapter 7 bankruptcy.  You must have financial counseling prior to
filing bankruptcy.  

If you do not qualify for chapter 7, but have enough monthly income left
over after monthly obligation, you will qualify to file Chapter 13  bankruptcy.
